CLIENT CHARGED WITH AGGRAVATED DWI AFTER BLOWING A .21 TWICE ON THE

SPOTTED A TRUCK THAT HAD COME TO A STOP OFF THE SIDE OF THE ROAD IN A
SNOWBANK. THE OFFICER INVESTIGATED AND
FOUND NO ONE INSIDE. HE AND OTHER
OFFICERS BEGAN SEARCHING FOR THE DRIVER, WHO THEY EVENTUALLY LOCATED. THE DRIVER WAS ARRESTED AND CHARGED WITH
DRIVING WHILE INTOXICATED (“DWI”) AND “AGGRAVATED DWI”.

Please note-this is an example of
the disposition of a recent
TRIAL: The state produced the testimony of two police officers who arrested the driver. Attorney Stevens cross examined the officers and argued that the defendant’s rights were violated during the roadside interrogation, and that all the evidence after the interrogation should be suppressed (thrown out). At the trial, Attorney Stevens moved to DISMISS the charges. The Court granted the motion to dismiss.
RESULT: AGGRAVATED DWI AND DWI CHARGES DISMISSED!!!
